Judge Marguerite Wageling said she was having a hard time believing that Berry was growing all of the marijuana for his own use. But she agreed with the defense attorney that Berry was not a drug kingpin.
He also could have been fined $200,000, but Wageling fined him $500.
"Someone can't be all that smart to go on YouTube and post the types of video footage that you did," Wageling said.

"Showing how to grow it, how to set it up, what chemicals he uses, where he gets his seeds," said Assistant Rockingham County Attorney Jerome Blanchard. Eventually, Berry made several mistakes. In one video, his face was reflected off a shiny surface. Blanchard said there was other direct evidence identifying him.

Berry pleaded guilty to manufacturing a controlled drug. Prosecutors said that last fall, he posted several videos online that showed his marijuana growing operation in the basement of his Auburn home.
